The United States Citizenship and Immigration Services adjusts any form or document that every employee that works in the United States on a regular basis. Most recently, the I-9 Form had an update which added a translator/preparer part to the form.

So if your newly hired employee cannot speak English, the form can be completed with a translator that ensures the employee’s information and verifies the conduct. This is because Form I-9 doesn’t have a version outside of English like W-4 Employee’s Withholding Allowance and Certificate form which has a Spanish version.

Should I submit I-9 to the USCIS?

Absolutely, not. The sole purpose of the Form I-9 is to verify the legal authorization to work in the United States of the employees. Each form of the employees must be kept in the personnel files and not complying with the law can result in penalties up to $20,000.

Of course, this is a very far extension of it and the penalties wouldn’t go as high as that for the most part in case of an inspection by the Immigration and Customs Enforcement.

Filing the Form I-9
